These terms govern your use of Semperia (the "Service"), operated by Semperia, ID: pending registration, registered office: EU-based service operator ("we", "us"). By creating an account, you ("User") accept these terms.
Semperia lets users record video, voice or text messages, store them encrypted, and share them with loved ones via QR-coded magnets. Messages remain inaccessible until the recipient scans a magnet and the User (or their trusted contact) approves, or until an auto-approval timeout (1–7 days) elapses.
You must be at least 18 years old and have full legal capacity to enter into contracts. You are responsible for the accuracy of information you provide during registration.
You are responsible for keeping your password secure. We are not liable for unauthorized access to your account resulting from your failure to do so. Notify us immediately at support@semperia.eu if you suspect unauthorized access.
The Service uses one-time payments. There are no recurring charges. Prices and tier features are shown on the pricing page. Payment is processed via Stripe. All prices include VAT where applicable.
Your purchased tier defines the active limits for videos, voice notes, written messages, documents, storage, Memory QR profiles, family vaults and included physical QR carriers. If you reach a limit, you can reduce stored content, upgrade, or buy a paid add-on if one is available.
Media uploads may be compressed or converted to an efficient delivery format so the one-time plan model stays sustainable. Semperia is not intended as an unlimited original file backup. Physical QR carriers are prepared only after we receive the required shipping details. Optional future add-ons may be priced separately.
As an EU consumer, you have the right to withdraw from this contract within 14 days without giving any reason. To exercise this right, email us at support@semperia.eu.
Important: The Service is digital content. By starting to use the Service (recording or uploading a message) within the 14-day period, you expressly request that performance begin and acknowledge that you lose your right of withdrawal under EU Directive 2011/83/EU, Art. 16(m). If you have not yet uploaded any content, a full refund is available within the 14-day window.
You retain all rights to the content you upload. You grant us a limited, non-exclusive, worldwide licence to store, encrypt, transmit and display your content solely to provide the Service. We do not access plaintext content (technical and procedural controls ensure this); content is encrypted with keys derived per user.
You agree not to use the Service to:
Violation may result in immediate account termination without refund.
We strive for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance. We are not liable for downtime caused by third-party providers (Supabase, Cloudflare R2, Vercel, etc.) or force majeure events.
To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid for your current tier. We are not liable for indirect, consequential, or punitive damages.
This does not limit liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be limited under applicable law.
You may delete your account at any time via Settings → Delete account. We may suspend or terminate your account for material breach of these terms with reasonable notice (or immediately for severe violations like illegal content). On termination, your content and account data are deleted as described in our Privacy Policy.
We may update these terms. Material changes will be communicated by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not accept, you may terminate your account.
These terms are governed by the law of the Czech Republic, excluding its conflict of laws rules. Disputes will be resolved by the competent courts of the Czech Republic. As an EU consumer, you also have the right to bring an action in the courts of your country of residence and to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
